Inspector Agreement

This Inspector Agreement is made between Inspect Global Pro (“Platform”) and the registered Inspector (“Inspector”).

  1. Role of Platform
    Inspect Global Pro acts as a digital marketplace connecting businesses with independent inspectors. The Platform does not directly provide inspection services.
  2. Independent Contractor Status
    The Inspector is an independent professional and not an employee, agent, or partner of the Platform.
  3. Assignment of Work
    Inspection assignments will be allocated through the platform. The Inspector agrees to perform assigned work professionally and within agreed timelines.
  4. Reporting Obligations
    The Inspector must submit accurate and complete inspection reports through the platform. Any false or misleading report may lead to termination.
  5. Confidentiality
    The Inspector shall not disclose client information, inspection details, or any confidential data to third parties.
  6. Non-Circumvention (IMPORTANT)
    The Inspector agrees not to directly contact, solicit, or accept work from any client introduced through the platform outside of Inspect Global Pro. This restriction shall remain valid during engagement and for a period of 12 months after the last assignment.
  7. Payment Terms
    Payments will be processed through the platform as per agreed terms. Inspectors shall not request direct payment from clients.
  8. Code of Conduct
    The Inspector must maintain professionalism, follow safety standards, and comply with applicable laws.
  9. Termination
    The Platform reserves the right to suspend or terminate the Inspector account for misconduct, breach of terms, or poor performance.
  10. Liability
    The Inspector is solely responsible for the quality and accuracy of their work.
  11. Governing Law
    This agreement shall be governed by the laws of India.
  12. Misconduct, Professional Negligence & Breach
    The Inspector shall perform all inspection services with due diligence, professional competence, and in accordance with applicable industry standards and best practices.
    Any act of misconduct, including but not limited to:
    • Submission of false, fabricated, or misleading information
    • Improper, negligent, or incomplete inspection
    • Failure to follow client requirements or inspection scope
    • Misrepresentation of qualifications or experience
    • Unprofessional behavior at site shall constitute a material breach of this Agreement.
  13. Penalty and Liquidated Damages
    In the event of any breach, misconduct, negligence, or violation of platform policies, the Platform reserves the right to impose liquidated damages up to INR 50,000 (Rupees Fifty Thousand only) per incident.
    The Inspector expressly agrees that such amount represents a reasonable pre-estimate of damages and is not a penalty.
    The Platform shall have the right to recover such amount by:
    • Adjusting against pending payments
    • Direct recovery from the Inspector
    • Initiating legal proceedings, if required
  14. Suspension, Termination & Blacklisting
    Without prejudice to other rights, the Platform may:
    • Immediately suspend or permanently terminate the Inspector’s account
    • Restrict access to assignments
    • Blacklist the Inspector from future engagements
    The minimum suspension period shall be 12 (twelve) months, which may be extended at the sole discretion of the Platform depending on severity.
  15. Indemnity
    The Inspector agrees to indemnify, defend, and hold harmless Inspect Global Pro, its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, or expenses arising out of:
    • Negligent or improper inspection
    • Incorrect or misleading reports
    • Violation of laws or third-party rights
    • Breach of this Agreement
  16. Non-Circumvention & Non-Solicitation
    The Inspector shall not directly or indirectly solicit, engage, or enter into any business relationship with clients introduced through the Platform outside of the Platform.
    This obligation shall remain valid during the term of engagement and for a period of 12 (twelve) months after the last assignment.
    Any violation shall attract strict action including penalties and permanent termination.
  17. Confidentiality
    All client data, inspection details, reports, and platform information shall be treated as strictly confidential.
    The Inspector shall not disclose, share, or use such information for any purpose other than completion of assigned work.
  18. Limitation of Platform Liability
    The Platform acts solely as an intermediary connecting Inspectors and Clients.
    The Platform shall not be liable for:
    • Quality of inspection work
    • Errors or omissions in reports
    • Any direct or indirect damages arising from inspection activities
  19. Governing Law & Jurisdiction
    This Agreement shall be governed by and construed in accordance with the laws of India.
    All disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal.
  20. Binding Acceptance
    By registering on the platform, the Inspector confirms that they have read, understood, and agreed to all terms and conditions stated herein, and such acceptance shall be legally binding.
  21. Payment Terms
    The Inspector shall be entitled to receive payment for successfully completed inspection assignments as per the agreed rates on the platform.
    All payments for inspection services performed during a particular calendar month shall be processed and paid by the Platform on or before the 15th (fifteenth) day of the immediately succeeding month.
    For example, payments for assignments completed in the month of January shall be processed on or before 15th February.
    Payments shall be subject to:
    a) Successful completion of the assigned inspection
    b) Submission of complete and acceptable inspection reports
    c) No dispute or complaint from the client regarding the quality of work
    d) Compliance with all platform terms and conditions
    The Platform reserves the right to withhold, adjust, or delay payments in case of:
    • Incomplete or incorrect reports
    • Client disputes or complaints
    • Breach of agreement or misconduct
    All payments shall be made through bank transfer or other approved modes as determined by the Platform.
    The Inspector shall not demand or accept any direct payment from clients for assignments received through the Platform.
